The Personal Data (Privacy) Ordinance – Personal Information Collection (Client) Statement

In compliance with the Personal Data (Privacy) Ordinance, you are now informed of the following:

(a) The Client understands that the Client may have been or may in future be requested to supply personal information from time to time to CPYI, CPYS and/or CPYF, relating to the Client, and in the carrying out of transactions contemplated under the Agreement, further information shall or may be collected by CPYI, CPYS and/or CPYF (all such information is referred to as “data” in this Section).

(b)The Client understands that a request for data on the “Account Opening Form” or otherwise shall oblige the Client to complete the same, and any failure so to do may result in CPYI, CPYS and/or CPYF being unable to open or continue the account, or unable to effect transactions under the account.

(c)The Client understands that CPYI, CPYS and/or CPYF may provide data received from the Client to the following persons:

1. any other member, subsidiary , associated company or affiliate of the CPY Group anywhere in the world for various purposes set out in Paragraph (d) under this Section;



2. any nominees in whose name the Security or other assets may be registered;



3. any contractor, agent or service provider which provides administrative, data processing, financial, computer, telecommunication, payment or security clearing, professional or other services to any member of the CPY Group or to any other person to whom data is passed;



4. any person with whom CPYI, CPYS and/or CPYF enter into or propose to enter into transaction on the Client’s behalf or account, or persons representing the same;



5. any assignee, transferee, participant, sub-participant, delegate, successor or person to whom the Agreement is novated;



6. governmental, regulatory or other bodies or institutions, whether as required by law, regulations applicable to any member of the CPY Group, or otherwise;



7. any person with the express or implied consent of the data subject;



8. any person where the interests of the CPY Group require disclosure;



9. any person where the public interest requires disclosure;



10. any person who is engaged to provide services in the normal course of securities and futures business;



11. any other person under a duty of confidentiality to the relevant member of the CPY Group including an affiliated or associated company of a member of the CPY Group which has undertaken to keep such information confidential;



12. auditors or legal advisors of the CPY Group;



13. credit reference agencies and, if a data subject is ever in default of payment to the relevant member of the CPY Group or otherwise, debt collection agencies;



14. any financial institution with which the Client has or proposes to have dealings; and



15. any person who requests the relevant member of the CPY Group to provide references in respect of data subjects upon producing proof of data subjects’ prescribed consent.

(d) The Client understands that the purposes for which the data provided by the Client from time to time may be used are:

1. giving effect to the Client’s orders relating to transactions or otherwise, and carrying out the Client’s other instructions;



2. providing services in connection with the Account, whether the services are provided by or through any member of the CPY Group or any other person;



3. conducting credit enquiries or checks on the Client and ascertaining the Client’s financial situation and investment objectives, and enabling or assisting any other person so to do;



4. collection of amounts due, enforcement of security, charge or other rights and interests in favour of any member of the CPY Group;



5. researching, designing, launching, promoting and marketing existing and future services or products of any member of the CPY Group, or its affiliated or associated company;



6. forming part of the records of the persons or members of the CPY Group to whom the data may be passed;



7. observing any legal, regulatory or other requirements to which any member of the CPY Group or any other persons may be subject; and



8. other purposes related or incidental to the ordinary course of business of any member of the CPY Group or any one or more of the above.

(e) The Client understands that the Client may request a copy of such data or correction of the data. Any such request may be addressed to the Head of Risk Management Department of the CPY Group at 36/F., COSCO Tower, Grand Millennium Plaza, 183 Queen’s Road Central, Hong Kong. The Client understands that a fee shall be charged by CPYI, CPYS and/ or CPYF for any such request.

The Client understands that any member of the CPY Group may use the data and supply the Client with information about other services or products of any member of the CPY Group, or its affiliated or associated company. The Client understands that, if the Client requests, without charge to the Client, any member of the CPY Group is required to cease to use the data for such purpose, and if the Client so inform CPYI, CPYS and/or CPYF in writing, the data shall be ceased to be so used.
